European Regulation No. 679/2016 on the protection of personal data and subsequent national laws of adaptation

Protecting your privacy is one of our main goals.

In line with the commitment and care that Az. Agr. Venetian Hills® devotes to the protection of personal data, we inform you about the methods, purposes, and scope of the communication and dissemination of your personal data collected when accessing vignadelpendio.it, as well as your rights, in accordance with Articles 13 and 14 of the European Regulation No. 679/2016 and subsequent national laws of adaptation. 

WEBSITE PRIVACY POLICY

This section contains information concerning the management of personal data with reference to their processing on the website www.vignadelpendio.it. In compliance with Legislative Decree 196/2003 as amended by Legislative Decree 101/2018 and the Regulation, Az. Agr. Venetian Hills® aims to ensure the privacy and security of the personal data of each visitor in accordance with what is prescribed in this Notice, thereby the treatments will be based on the principles of legality, correctness, transparency, limitation of purpose and retention, data minimization, accuracy, integrity, and confidentiality.

The information is provided only for the site and not for other websites that may be consulted by the user via links contained therein.

The purpose of this document is to provide guidance on the modes, timing, and nature of the information that the Data Controller must provide to users when connecting to the web pages of the site, regardless of the purposes of the connection itself, according to Italian and European legislation.

If the user is under 16 years old, in accordance with Article 8, Clause 1 of EU Regulation 2016/679, they must legitimize their consent through the authorization of their parents or guardians.

  1. Personal Data Subject to Processing and Purpose

By processing personal data, we mean any operation or set of operations, performed with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, restriction, erasure or destruction.
We inform you that the personal data subject to processing will consist, also depending on your decisions on how to use the services of the Site; of an identifier such as the name, email address, an identification number, data related to location, an online identifier, and other data capable of making you identified or identifiable, depending on the type of Services requested. In particular, the Personal Data processed through the Site are the following:

 

Navigation Data

The computer systems and software procedures used for the operation of this website acquire, during their normal operation, some personal data whose transmission is implied in the use of Internet communication protocols. This category of data includes: IP addresses, the type of browser used, the operating system, the domain name, and the addresses of websites from which access was made, information on the pages visited by users within the site, access time, stay on the single page, internal path analysis, and other parameters related to the user's operating system and computer environment.

These are pieces of information that are not collected to be associated with identified concerned parties but, by their very nature could, through processing and associations with data held by third parties, allow users to be identified.

These data are used only for the purpose of obtaining anonymous statistical information on the use of the site and to check its correct functioning, to identify anomalies and/or abuses, and are deleted immediately after processing. The data could be used for the ascertainment of liability in case of hypothetical computer crimes against the site or third parties: except for this possibility, at the current state web contact data does not persist for more than fourteen days unless there are requests by the user (e.g., access to the personal pages of the user within the site that summarizes the services used, published information, etc.).

b. Data Voluntarily Provided by the Interested Party

Identifiers provided by the user as the interested party and/or on behalf of another natural person (e.g., name, surname, email, phone number, location, etc.), Traffic Data

In the context of the email service, Az. AGr. Venetian Hills ® will process some data for the purpose of transmitting communications on the electronic communication network. These data are those listed in the Legislative Decree of May 30, 2008, No. 109, namely:

  • the IP address used, and the email address and any additional identifier of the sender;

  • the IP address and the fully qualified domain name of the mail exchanger host, in the case of SMTP technology or any type of host related to a different technology used for the transmission of communication;

  • the email address, and any additional identifier, of the recipient of the communication;

  • the IP address used for receiving or consulting email messages by the recipient regardless of the technology or protocol used;

  • the date and time (GMT) of the connection and disconnection of the email service user on the internet and the IP address used, regardless of the technology and protocol employed;

  • the internet service used.

These data are processed and stored by Az. Agr. Venetian Hills ®, through the service provider, to provide the service and by legal obligation, for the purpose of ascertaining and suppressing crimes. Appropriate security measures are adopted that make them accessible only to persons specifically authorized in writing, who access them only upon request of the judicial authority accompanied by a motivated decree of public prosecutor and in any case with particularly sophisticated authentication techniques provided by the legislation.

 

 

  1. Purposes and Legal Basis for Processing

Personal data will be processed exclusively in ways and procedures necessary to:

  • allow registration to the Site and the use of services reserved for registered users;

  • execute the user's requests, also for general assistance and customer care activities;

The legal basis for this processing is the performance of the contract and/or the execution of pre-contractual measures taken at the request of the data subject (Art. 6.1.b) of the Regulation, as well as for the legitimate interest of the Data Controller (Art. 6.1.f) of the Regulation.

The provision of data for the purposes mentioned is optional: there is no legal or contractual obligation to communicate data; however, since their processing is necessary to allow registration through the Site, or to respond to precontractual requests made by the user, the failure to communicate data will result in the impossibility for the user to access or register on the Site. Additionally, for the purposes of the Site's security, data recorded automatically, such as the IP address, could be used, in accordance with applicable laws, to block attempts to damage the site itself or to harm other users, or in any case harmful activities or activities constituting a crime.

  1. Recipients of personal data

Within the scope of the purposes indicated above, your data may be communicated to:

  • third parties, such as professionals including tax and legal advisors, IT services and support companies, shippers, third-party companies that carry out part of the processing activities and/or activities related and instrumental to them on behalf of the Data Controller. These subjects will also be appointed as data processors pursuant to Article 28 of the GDPR;

  • subjects, entities, or authorities to whom it is mandatory to communicate your personal data by virtue of legal provisions or orders from the authorities (for example, during criminal investigations, the Data Controller may receive requests from the judicial authority to provide electronic traffic logs);

  • individual individuals, employees, and/or collaborators of the Data Controller, who have been assigned specific and/or various processing activities on your personal data. These individuals have been given specific instructions on security and proper use of personal data and are defined as persons authorized to process personal data under the direct authority of the Data Controller (pursuant to Article 29 of the GDPR).

This information on the processing of personal data applies to the website www.vignadelpendio.it, as well as to the online services associated with the aforementioned site.

It does not apply to any links to external sites related to external companies and institutions. For information on the purposes, types, and methods of collection, processing, use, and storage of personal data by external platforms and/or social networks, as well as on how to exercise your rights, please consult the privacy policy adopted by the individual site.

  1. Transfer of Personal Data

Personal data will be processed by Az. Agr. Venetian Hills®, within the territory of the European Union. Should it become necessary for technical and/or operational reasons to rely on entities located outside the European Union, or if it becomes necessary to transfer some of the collected data to companies located outside of the European Union area, the processing will be regulated in accordance with provisions of Chapter V of the Regulation and authorized based on specific decisions of the European Union.

  1. Methods of Processing and Retention Time of Personal Data

The processing of personal data is carried out using manual, computerized, and electronic tools with logic strictly related to the purposes themselves in order to ensure their security and confidentiality.

The data related to navigation logs recorded will be retained by the provider for a minimum period of 6 months, as required by the normative retention periods.

  1. Rights of Data Subjects

Individuals to whom the aforementioned personal data refer have the right to exercise their rights in the manner and within the limits established by the current privacy legislation, from Article 15 to 22 of the GDPR.

In relation to the processing of your personal data, you have the right to ask Az. Agr. Venetian Hills® for access: you can request confirmation as to whether or not data pertaining to you is being processed, in addition to further clarifications regarding the information presented in this Notice, and to receive the data itself, within the bounds of reasonableness;

  • rectification: you can ask to rectify or complete the data you have provided us or that we otherwise hold, should it be inaccurate;

  • erasure/forgotten: you can request that your data acquired or processed by the Data Controller be deleted, if it is no longer necessary for our purposes or if there are no ongoing disputes or controversies, in case of withdrawal of consent or your opposition to processing, in case of unlawful processing, or if there is a legal obligation to delete;

  • restriction: you can request the restriction of the processing of your personal data, when one of the conditions mentioned in Article 18 of the GDPR applies; in this case, your data will not be processed, except for storage, without your consent except for what is explicitly stated in the said article in paragraph 2.

  • objection: you can object at any time to the processing of your data on the basis of our legitimate interest, unless we have legitimate grounds for processing that override your interests, for example, for the exercise or our defense in legal claims; your objection will always prevail over our legitimate interest in processing your data for marketing purposes;

  • portability: you can request to receive your data, or to have it transmitted to another controller indicated by you, in a structured, commonly used and machine-readable format.

Modifications

The document has been updated on 11/10/2024 to comply with regulatory provisions, specifically in accordance with Regulation EU 2016/679.

Az. Agr. Venetian Hills® reserves the right to modify or simply update its content, in part or in whole, also due to changes in applicable legislation. Should the modifications to this policy involve substantial changes in processing or might significantly impact the data subjects, Az. Agr. Venetian Hills® will ensure to duly notify them.
